Cleo T. Wiley v City of Detroit et al, Detroit City Council, George Cushingberry Jr. - The Drama Continues

The taxpayers of the City of Detroit are under attack again from a sexual harassment lawsuit filed by Cleo T. Wiley in the 3rd Judicial Circuit Court, Wayne County Michigan. On Wednesday March 11, 2020, US District Court Judge Marianne O. Battani dismissed all charges against the City of Detroit, Detroit City Council Members and, retired State Representative and former Detroit City Council-member George Cushingberry Jr. In her 23 page ruling, Judge Battani ruled that Cleo Wiley did not have sufficient evidence of sexual harassment and, was not entitled to protection under Title VII of the Civil Rights Act of 1964 as an Independent Contractor.  The court properly ruled that anyone working for a Detroit City Council member under a personal services contract is an at will employee subject to immediate dismissal. 

On Friday March 13, 2020, attorney Robin Beth Wagner filed the same charges with 3rd Circuit Court Judge Dana Margret Hathaway using State of Michigan Elliot/Larsen discrimination laws. The schedule of events for the case per order of Judge Hathaway:
  1. Witness Exchange Filing:  September 4, 2020
  2. Discovery Cutoff Date:      October 23, 2020
  3. Case Evaluation Month:    December 2020
After step three is completed, two events are required to occur by court rule. The first one is a settlement conference and, the second one is a motion to dismiss the charges. Unless a motion to dismiss is filed within 30 days or, a settlement conference for both parties is held within 42 days the case will proceed to trial. It is noted in the record by Judge Battani that allegations are dismissed at the state level because of similarities between state and federal laws. 

The pursuit of this lawsuit the plaintiff is another attempt to shake down the taxpayers of Detroit for money. During George Cushingberry's time as President Pro-Tempore of City Council, he was responsible for putting in rules to prevent attack by plaintiffs filing frivolous lawsuits against the city.  He was also responsible for installing automation for the City Parking Department in 2015 generating over $200,000 dollars in revenue within one month of implementation. Among other monetary gains for the city, assets like Detroit City Airport and Benjamin O. Davis Aerospace High School were protected from the plans of Mayor Mike Duggan to shut it down to build more buildings that we don't need, given the massive vacancy rate of existing structures in the city.

After further review of his four year term on the Council, the incidents regarding former Council member George Cushingerry regarding a "high speed" police chase, antique cars and, sexual harassment charges were falsehoods promoted by Fox 2 Detroit News, led by former reporter M.L. Elrick. 

The car chase was proven to be false, the "antique" car was sold much less than value than advertised and, the sexual harassment charges were dismissed in court. Out of respect for the great men and women of the Detroit Police Department, police brutality charges and filing false police report charges were never pursued against the officers. Instead, we directed Chief James Craig to lecture the two officers on their mistakes and, to never, ever treat another citizen like that again. The culmination of these falsehoods served as grounds for dismissal of Mr. Elrick from Fox 2 Detroit in December of 2019.

In summary, the #MeToo movement must be held accountable for promoting women to pursue frivolous lawsuits to extort money from individuals, smearing elected officials, influence elections of candidates for public office and, professionals in private businesses for financial gain. Extortion is a crime and harms women with legitimate claims. For that indiscretion, the accusers should be punished to the fullest extent of the law for extortion, filing false police reports and slander.

By February 2021, we truly hope that this fiasco is brought to a decisive end.

George Cushingberry Jr. Acquitted of All Charges In Federal Court

On March 11, 2020  US District Court Judge Marianne O. Battani dismissed all charges against retired Michigan State Representative and former Detroit City Council-member George Cushingberry Jr.  In a 23 page ruling, Judge Battani ruled that Cleo Wiley did not have sufficient evidence of sexual harassment and, was not entitled to protection under Title VII of the Civil Rights Act of 1964 as an Independent Contractor.  The court properly ruled that anyone working for a Detroit City Council member is an at will employee subject to immediate dismissal.  When you accept a job as a legislative aide, you have a resignation letter already filled out.




A review of the record shows that Ms. Wiley took revenge against Mr. Cushingberry because he rejected her sexual advances after a brief affair in 2008.  When the affair ended, she continued to work for him until 2017. The record is clear in showing that:

  • Ms. Wiley maliciously tried to include other women and, men who did not support her claims of sexual harassment.
  • Ms. Wiley was involved in other relationships while pursuing Mr. Cushingberry for sexual harassment allegations.

The record shows that the timing of the  filing was done under the guise of the #MeToo movement for financial gain and, to prevent the re-election of George Cushingberry to the Detroit City Council in 2017 and, the Michigan State Senate in 2018. 

Like #metoo victim Congressman John Conyers, George Cushingberry Jr. has since retired from politics and practicing law. He is enjoying life again with friends, family and, thankful that this case is finally over.

It is with great pleasure to report that the City of Detroit is standing behind former Detroit City Councilmember President Pro Tem George Cushingberry Jr. He will not need to hire a private lawyer to defend himself against frivolous charges. After further review of all evidence, Corporation Council Lawrence Garcia filed a response brief with the Court in late July, dismissing the claims of the accuser Cleo Wiley Hale as an abuse of the sexual harassment #MeToo movement.

Strong evidence shows that she maliciously worked to sabotage the re-election campaign of George Cushingberry on behalf of other candidates and, is actively doing it again. Screen Out The Elrick Blitz With Your Vote Today - Say NO to Adam Hollier

There is good news for supporters of Marijuana reform this week. Signature collectors in Highland Park Michigan gathered 1343 signatures to allow the city to opt into State Marijuana law. Highland Park has 8553 registered voters and 10% or 853 valid signatures were needed to get the job done.  The City Council has two choices, either adapt the proposal as is on August 14th, or, let the people decide at the ballot box on November 6th.

In Hamtramck city leaders met with entrepreneurs who want to open facilities in the city. At the time of this writing, citizens were receptive and very supportive but no action was taken. In order to be on the November ballot a citizen petition initiative would have needed to be turned in by July 31st, 4pm to the City Clerk.




As the Senate race in District 2 winds down, I am reviewing all of the mailings that I received from the candidates. It is very true that candidates are being sponsored by people who do not have our best interests at heart.  The most offensive one was from a paid progressive candidate from Hamtramck who told the voters to “Stop Reading” and “Start Changing” using news clips from mainstream media.  There is a difference between being progressive and being young and stupid. How dare a candidate tell people to stop reading with the massive low comprehension rate among our citizenry? Over 50% of applicants to jobs are rejected because they cannot read nor write. Shame on you Abrham Aiyash! 

This progressive aggressive campaign plan is fraught with people running who would rather read a tweet than a book for knowledge. Reality show politics does not cut it when you have to make and design policy that will benefit everyone.

If you cast your vote for George Cushingberry,  on August 7th,  he promises that on the next day, he will introduce legislation declaring City Airport as a Historic District. This law will generate needed revenue with new and improved runways, commercial air service, and a flight training school. When it is all combined this project will bring more revenue than the current 75 marijuana provisioning centers in the City of Detroit.

The insurance industry auto rates are one of the main reasons people are leaving the scene of an accident, or not stopping for hit and run victims. Now they want to present a slate of candidates to cover their tracks if elected. Their policies in Lansing have contributed to the poverty of our citizens. People cannot get licenses and they drive without them and just forget about the insurance.  We are turning our police departments into insurance collection agents when people need to get back and forth to work. 




What has George Cushingberry Jr  Done for the people?
In 2014, Saved the city $20,000 month in costs by stopping the payments to a software company charging the Detroit Fire Department for software that did not work. Code Red was Code Wrong and a payoff for the Bing/Hollier administration

If you give George Cushingberry the chance to be your Senator, common sense insurance rates and regulation with a strong Attorney General fighting for the people will be the order of the day. George will stabilize inconsistent rates statewide. Red lines belong on Ice Hockey rinks instead of neighborhoods.

Given the rejection by Oakland and Macomb Counties on regional transit, one way to solve this problem is through a state and federal massive public works infrastructure project. This comprehensive project will  replace the sewers, water and, build a regional rail system that connects to Amtrak and VIA railroad in Canada.  This will create lots of jobs and money recirculating back into the community. A good example is the sewer separation in Lansing Michigan that created better roads after the new pipes were laid down. With the current occupant of the Office of the President of the United States, this will never happen.

A vote for Adam Hollier is a quick return to the failed Educational Achievement Authority that operated as a criminal business enterprise upon the Detroit Public School System.

The victims of the crime are the Children and the integrity of public education. From the first chancellor to principals of schools, the supporters of Hollier’s candidacy are counting on people not reading to finish the job they started on looting public education.  Just look at the great work they did with our schools like Benjamin O. Davis Aviation academy and Palmer Park (aka Hampton JR High School). The financial damage inflicted upon the Detroit Public School District by these emergency managers is inexcusable and the violators should be prosecuted. Hopefully our next Attorney General Dana Nessel can work on the Detroit School Board to restore the integrity to education.

As for voting for Brian Banks, c’mon man!  The 2nd coming of Virgil Smith is running an expensive campaign that if he got elected, we would be without representation again because he would have to resign again because of looming legal problems of a life in prison for being a habitual offender if convicted again. It is clear that the insurance industry lobby is sponsoring him to divide the vote like last time.



Don't Get Confused by Watching Fox News.

This is no time to experiment with another bunch young so called progressive rookies endorsed by endless money of television commercials, mailings, bulletin boards and dazzling websites, sponsored by groups that do not have the people’s best interest at heart. Voting for Hollier, is another vote for the plan of the KKK. They support Aiyash because he does not want you to read and, Banks is sponsored by people that know he will be legal trouble again forcing him to resign or go to jail for life. We do not need a repeat of the Virgil Smith fiasco and the sexual harassment blitz sponsored by alt-right Fox News network. The City of Detroit will protect the taxpayers from frivolous lawsuits. We don't need a make work program for lawyers, we need a make work program for our infrastructure.

Why #WeToo are Voting For George Cushingberry as State Senator

The August Primary election is a very important election to participate in. As in all elections the direction of your community and the quality of life is at stake. We are experiencing now the game plan of the opposition as we pursue your vote and trust to send us to Lansing to get the job done. The insurance companies have contributed to the downfall of Michigan through outrageous rates and price fixing. This is the main reason people are running from accidents to avoid prosecution. We have City of Detroit leadership wanting to build more buildings on the grounds of Detroit City Airport shutting it down while there are massive amounts of buildings available to do what he wants.  We have people endorsing candidates who have aided and abetted in the creation of the Educational Achievement authority that was raided by the Federal Government for fraud.

When George Cushingberry Jr. gets to Lansing MI, this is what he will do.

  • Implement Common Sense Insurance Rates
  • Restoring Accountability in Public Education with caps on the creation of charter schools
  • Re-Investing in the Mt. Elliot Development Project that includes a working Detroit City Airport for General, Educational, and Commercial use.
  • Taxation, Regulation of Marijuana including expunging ALL convictions in Michigan.


For example, as a State Representative, George Cushingberry sponsored a bill for good times credit for non violent offenders. As a Detroit City Council member, he was responsible for the upgrade of Livernois Avenue through implementing grants for streetlights, sidewalks, and supporting local businesses on the Avenue of Fashion.

The Sexual Harassment and the manipulation of the #MeToo movement is the new strategy to sabotage political campaigns. Just like the Ebola crisis that disappeared after the 2014 election, the sexual harassment and other negative "news", we are fully expecting this play call from the opposition. Sexual Harassment is gender neutral and all legitimate claims should be investigated. We feel that the timing of the filing was to get maximum damage from the City of Detroit and to derail the Cushingberry campaign.  When you examine the record of the other candidates, George Cushngberry has the documented proof of getting the job done.

Bear Bryant was quoted once as saying "In order to catch a fast negro running the ball, you have to hire another one to catch them" because he finally acknowledged the fact that you needed to include the black players he did not want on his team.  Distraction politics is only going to carry you so far and blitzing the campaign with charges and innuendo will not work. 

Therefore do not be confused by watching Fox News, just screen out their blitz with your vote for George Cushingberry Jr.

Fact: 

  • George Cushingberry Jr. still has his law license
  • The traffic stop was deemed to be unprofessionally handled by two patrol officers who wisely deleted the tape of their misconduct. 
    • We chose not to press charges against filing a false police report because we respect the men and women of the Detroit Police Department, especially the retirees. 
    • We want an apology written to Sgt. Smith by media reporters for promoting insubordination because of race.
  • The City's finances are no longer under the control of a State Appointed Manager under the direction of George Cushingberry Jr as the chairman of the Budget Audit Finance Committee.
  • George Cushingberry Jr. is the ONLY candidate on the ballot who has supported the legalization of marijuana and has history and evidence to prove it.
  • Will take on President Trump and Bill Schuette and scold them on their brand of exclusionary racist politics.

Don't get blinded by the blitz of bad news coming from media outlets like Fox and other haters.  Screen them out with your vote!

Sexual Harassment Is Gender Neutral Hyper-Political Warfare In 2018

The charges made by Ms. Wiley are an attempt to use the Sexual Harassment / #MeToo movement to shake down the Citizens of Detroit and, to derail the efforts of George Cushingberry Jr to become the next State Senator in District 2. As she has done before with the City Council primary election of August 2017, she is working as a political operative for other candidates on the ballot. Her only purpose now is to distract the voters enough to elect a candidate, who will maintain the status quo and, forced to resign, leaving the residents of District 2 without any representation again.

We believe wholeheartedly that the accusations are false and misleading for individual financial gain. We also agree with the City law department regarding Ms. Wiley's employment because before during and after the Florida trip, she has continually contacted potential suitors developing a close relationship with some of them within the state. 

Employees who have worked for George Cushingberry know that he is un-bought, un-bossed and, not for sale. Given the scrutiny of working for the public, transparency is a moral tenant and, a rule of doing business in public and private.



Kanye Was Right!  Don't matter if you are Black or White



While serving as the Council President Pro Tempore and, chairman of the Budget, Finance, and Audit committee, one of the things that was put in place was a law department to protect the people from frivolous lawsuits. Frequent lawsuit filers are a drain on budgets public and private and, divert precious resources away from needs such as employee health care costs and, creating jobs. 

It is our strong opinion that after all of the facts are examined, the best interests of the taxpayers in the City of Detroit will be upheld by the US District Court and, the case dismissed.

Sending George Cushingberry back to Lansing as a State Senator guarantees that when he gets there, he will work on:
  • Getting Michiganders common sense auto insurance rates
  • Public Education revitalization through a policy of stressing literacy and training opportunities for youth in aviation careers and skilled trades.
  • A revitalized Detroit City Airport with general and commercial air service bringing needed revenue to the City.
  • Re-balancing the State Budget to increase funding of Mental Health facilities, public education, and decreasing the Corrections budget through the expunging of low level drug crimes 
  • Curtailing abuse of Opioids, prescription drugs and other mood altering medicine sold by pharmacies for profit.

Show up and Vote all Summer Long from now until August 7th, and again on November 6th, 2018 and lets get it right this time!!

Chief James Craig Answers Questions Regarding 2015/2016 Budget from Pro-Tem Cushingberry

DPD 2015/2016 Proposed Budget recommendations. 

Councilmember Cushingberry cares about the Detroit Police Department so much that he is closely watching operations. He wants to make sure that citizen concerns and needs are addressed, 

On June 3,2015, Mr. Cushingberry asked the following questions of Police Chief James Craig.

List of Questions

1. In light of neighborhood/community policing, what are the efforts to encourage police offices to live in the City of Detroit?
2. How much have collected in the last three years from the various forfeiture programs?
3. Please provide details relative to new efforts in Information Technology ?
4. What steps should be taken to request Federal and State funds for a Blight Task Force and Quality of life blight deterrence?

Summary of Answers by Chief James Craig

1. Officers are being encouraged to live in the City by coordinating with the Detroit Public and Charter schools to provide education to Officer’s families.
2. We have collected a total of $6,045,732.02 dollars with $1,210,172.71 from Federal and $43,648.07 from the State  of Michigan collections divisions.
3. We are collecting more information from new fingerprint machines and other data requiring that we upgrade to 450TB of storage. We are upgrading hardware with 100 new units that have the Microsoft System Center Configuration and Operation Manager.
4. The Office of Grant Management can assist with providing information on seeking grants for this cause


We hope that the answers provided by Chief Craig will further enhance the transparency that the Department and the Council wants and the public demands of their public servants.

Michigan Attorney Discipline Board Dismisses Charges against Attorney George Cushingberry Jr.

    In a unanimous ruling on June 15, the Michigan Attorney Discipline board has administratively dismissed the charges against Attorney George Cushingberry Jr. for practicing law without a license. The hearing date was arbitrarily cancelled by the board. The panel ruled that the charges brought by M.L. Elrick lacked merit, was frivolous and not worthy of further discipline or discussion. This ruling dismisses the allegations made by Fox 2 Detroit reporter M.L. Elrick and Michigan Chronicle Editor Bankole Thompson.

Quoting University of Detroit Law Professor Larry Durbin and the Michigan Chronicle's Bankole Thompson:
LARRY DUBIN: You can't put yourself in a position where you can meet potential clients, which means have a telephone that lists you as a lawyer where people can call you; be on a website where people can fill out a form and indicate that they want your services as a lawyer; all of that is prohibited completely. Anything on a computer that would hold that suspended lawyer as a lawyer, or as a practicing lawyer or invite potential clients to contact that suspended lawyer would be improper. 'Michigan Chronicle' Editor Bankole Thompson says Cushingberry's apparent disregard for the rules sends the wrong message.
Larry Dubin’s statement of fact was ruled irrelevant and did not fit the case by the Attorney Grievance Commission because Mr. Cushingberry had evidence that he never practiced law during the suspension.  The panel also found that Attorney Cushingberry did not own the domain name and was not responsible for its content. It is a given fact that 98% of legal professionals are not tech savvy and, rely on assistance from Technology experts who are highly skilled in the tools of the trade. C-systems Technology Group www.csystemstechgroup.com is solely responsible for the maintenance, development and content of the site.

The owner of the domain www.cushingberrylaw.com was able to demonstrate that Attorney Cushingberry is not taking any clients during the suspension and, his databases cannot produce any evidence of ANY client or potential client interaction requesting his legal services. As far as the Michigan Chronicle goes, the last thing we need is an African American newspaper supporting and reporting news events that are later proven to be intentionally false and misleading bits of information.


It is also a fact that this is a troubling pattern by media outlets to usurp the will of the voters by attempting to remove elected African American officials from office by promoting false and misleading news stories. The Councilman is demanding that ML Elrick and Bankole Thompson issue an immediate retraction of this “story”. The councilman suggest that these two would be better off investigating the contractors who poured the concrete on the Highways and Roads in Michigan for the past 10 years with shoddy concrete and construction materials.  

Until this happens, the No Elrick-Thompson zone will remain in full effect until further notice.

Since being a council member, Mr. Cushingberry does not have the time to put into law while serving the citizens of our great city making things happen. An example is: since taking office, the Detroit Fire Departments technology has been massively upgraded with a WORKING mapping system that helps firefighters get to emergencies much faster and accurately. This move saved the department lots of money by redirecting funds from a non-working CODE RED computer system, to a hand held working Google Mapping App for each firehouse.  This app has a future so that the app can fit on every firefighter’s cell phone if needed.


Councilman Cushingberry and colleagues have awarded over $55,000 in grants to the DFD for equipment and spurring a hiring frenzy of new Firefighters, EMTs, and Detroit Police Officers to protect the people. These young men and women help carry on the legacy of the Motor City by protecting it as a good place to work, live and party. As we speak, City of Detroit computer systems are being upgraded from Win 3.1, Win 2000, Win XP,  to the latest MS Windows software and HP hardware to bring the City's technology into the 21 Century.

Councilman Cushingberry and his colleagues are working to get City of Detroit uniformed employees (Police and Fire) the same 2.5 percent adjustment awarded to all non-uniformed employees including the Council by the Compensation Commission in July 2016.  Detroit retirees are encouraged to investigate the use of the Voluntary Employee Benefit Agreement to their advantage. When manipulated properly by the members, retirees will re-gain the losses by re-negotiating deductibles and co-pays using the Affordable Care Act.

Please be reminded that Mr. Cushingberry has more credibility as a suspended lawyer than some journalists on Fox 2 and, the Michigan Chronicle have as employees.  As a lawyer Mr. Cushingberry has processed over 1000 cases in his career.  To our count Elrick has found four of them.  We know he had to get through all of them to find these four anomalies.  Regarding the widow issue with the car, Mr. Cushingberry, Swanson Funeral Home, and another agency were successful in dismissing the lawsuit filed by the widow for $20 million dollars a piece in damages.   On Elrick’s star witness Debra Goodner, she still has not produced a receipt for a retainer fee and, we are not holding our breath waiting.

Currently there are 87 people on the same list that ML Elrick accessed from the State of Michigan website. (click here to read the list of "sinners") The list includes Peter Hokesra for Governor and the late Rev. Michael Murphy.  Since most of them did not win or died, they just quit filing.  Mr. Cushingberry has since filed his report and this list will be amended to show that he had less than $50.00 owed for the 2010 Senate campaign.


While serving as a State Representative, Mr. Cushingberry was accused of the same thing in 2008 by then Attorney General Mike Cox when he was appointed the appropriations chairman of the House of Representatives. This case went to trial and, the councilman was victorious in proving that the charges were nothing but harassment and a backhanded attempt to remove him from the appropriations chairmanship.  In that position, Mr. Cushingberry was responsible for the budget of 21 State Departments and left it balanced when his term was limited.

We also want to remind the Nolan Finleys and the Bankole Thompsons of the world that our young people are carrying cell phones that have more computing power than all of the NASA spacecraft that went to the moon and back in the 60’s. They are very talented and with training can do ANY job that is offered to them. If these companies don’t want to hire them they will get the training elsewhere, come back and do a better job than the company that did not want to hire them in the first place. All we ask is that they use those smartphones for doing their research and homework in the process of getting their education. 


Finally we want to salute the young men and women of the Detroit Public School system who recently won a prize for building solar heating and electrical panels.  We know that this is our future and ticket to prosperity in the City of Detroit and, if you are in a business that uses a lot of electricity, then you may want to consider hiring one or many of them.  That’s if they don’t become entrepreneurs and open their own business.   Some of them may study journalism and learn how to report facts instead of, creating fiction from fact to sustain a theater act.

Transportation Magic on 8 Mile and Woodward creating a new neighborhood in Detroit

By clicking on this link, you will have a documented plan for the old Michigan State Fairgrounds from the Land Bank Authority.  This presentation will give you the actual 411 for the 157 acre location in Northwest Detroit. I along with the rest of my council members want you to have the actual plan for your records. The Magic Plus LLC group is strongly committed to hiring, training, and educating Detroit residents and like-minded citizens to improve the quality of life in our city. Councilmember Cushingberry is working with State and Federal agencies to construct a new AMTRAK station as an addition to the Magic Plus effort to redevelop the land.  

Future plans include the extension of the M1 rail line to 8 mile road and, construction of an east and west connection with the development of a M102 rail line going all the way from Lake St. Clair and points west to Livonia, Novi, and Wixom. It is high time for a regional rail system and places like the State Fair property and the old Northland Shopping center will make great hubs for regional transportation. This project will create 3 to 4 times more jobs than the current Meijer/Gateway project and, bring untold revenue to the County and City. Whereas we do not support the META group’s plan for the fairgrounds because it is rife with duplication of the Magic Plus group and does not serve the best interest of the City. 


Mayor Coleman Young always felt that the best thing for the City is working at a well-paying job with the City Services to match. Now that City employees and retirees can purchase property at %50 less than others, we want to encourage the re-investment by carrying it forward. Group purchase of homes on a block and people in them working in our Schools, Firehouses, and Police Precincts will contribute to the renaissance of Detroit.

Rapid Transit on Grand River and Gratiot will enhance the region’s growth and two bridges on the Detroit River will only add to the mix. Suggesting that a passenger light rail track be built on the old or new Ambassador Bridge may be a peace offering to settle the dispute with Mr. Maroun and everyone. Connection with DDOT and, VIA is a strong possibility if the details can be worked out. In the end it is time to stop bickering and start putting shovels in the ground to create jobs and prosperity for everyone to get the job done.
