USA v Daniel Dario Trevino - Injustice and the need for Weed Equity in Michigan

While the State of Michigan is granting recreational licenses for Marijuana to others, one of our citizens is in jail awaiting sentencing in a federal court for up to 20 years for doing the same thing. Daniel Trevino will be sentenced under federal guidelines for a "crime" that is making cities like Ann Arbor and Evart up to $200,000 a day.  Yet there is no outcry for justice from some in the Marijuana community. As a matter of fact, some of them support the federal governments efforts to keep Mr. Trevino in jail. This is highlight film for social equity efforts because Lansing Michigan is one of the cities on the list for social equity relief to victims of the war on drugs.

On August 23, 2019 Danny Trevino was found guilty by a jury of his "peers" in Federal Court in Grand Rapids Michigan on 10 counts of:
  • Maintaining a Drug-Involved Premises, 
  • Conspiracy to manufacture, distribute, and possess with the intent to sell marijuana. 

Mr. Trevino was convicted of possessing 100 or more plants at a business by the name of Hydro-World in Lansing and Jackson Michigan. Mr. Trevino was operating under state law as defined by the passing of Medical Marijuana in 2008. During that time he was harassed and raided 11 times while other businesses were doing business and making money in the marijuana industry.

This racist policy enforced by Attorney General Bill Schuette and 1st ward Lansing City Council-member Jodi Washington targeted mostly minority business owners and, others who did not have the capital assets to stay in business in 2010 under the Snyder administration. On January 28th, 2020 Mr. Trevino will be sentenced to a term of between 262 to 327 months in federal prison while the state of Michigan grants licenses to new business owners in Ann Arbor, and other cities to do the same thing that Danny was doing in Michigan.

What can you do to help Danny? 

Between now and January 28th 2020, contact the judge and request that he ignores the guidelines of the US sentencing commission and, recommend that be sentenced to time served. Furthermore, that Mr. Trevino be allowed to apply for a business license under Michigan's social equity program for Marijuana entrepreneurs.

Contact your federal elected officials in Michigan and the President of the United States to commute the sentence because, the people have spoke with their vote to free the weed for the jobs they want and, the jobs we need.  The people support the manufacturing products from the Cannabis plant to create jobs in industries like concrete manufacturing (hemp-crete), clothes, fuel, and other byproducts of the cannabis plant.

To allow this man to go to prison while others make millions is an intolerable injustice. This man must be released and, any elected official that supports this injustice shall be removed by a vote of the people on election day in August and November of 2020.

There is good news for supporters of Marijuana reform this week. Signature collectors in Highland Park Michigan gathered 1343 signatures to allow the city to opt into State Marijuana law. Highland Park has 8553 registered voters and 10% or 853 valid signatures were needed to get the job done.  The City Council has two choices, either adapt the proposal as is on August 14th, or, let the people decide at the ballot box on November 6th.

In Hamtramck city leaders met with entrepreneurs who want to open facilities in the city. At the time of this writing, citizens were receptive and very supportive but no action was taken. In order to be on the November ballot a citizen petition initiative would have needed to be turned in by July 31st, 4pm to the City Clerk.




As the Senate race in District 2 winds down, I am reviewing all of the mailings that I received from the candidates. It is very true that candidates are being sponsored by people who do not have our best interests at heart.  The most offensive one was from a paid progressive candidate from Hamtramck who told the voters to “Stop Reading” and “Start Changing” using news clips from mainstream media.  There is a difference between being progressive and being young and stupid. How dare a candidate tell people to stop reading with the massive low comprehension rate among our citizenry? Over 50% of applicants to jobs are rejected because they cannot read nor write. Shame on you Abrham Aiyash! 

This progressive aggressive campaign plan is fraught with people running who would rather read a tweet than a book for knowledge. Reality show politics does not cut it when you have to make and design policy that will benefit everyone.

If you cast your vote for George Cushingberry,  on August 7th,  he promises that on the next day, he will introduce legislation declaring City Airport as a Historic District. This law will generate needed revenue with new and improved runways, commercial air service, and a flight training school. When it is all combined this project will bring more revenue than the current 75 marijuana provisioning centers in the City of Detroit.

The insurance industry auto rates are one of the main reasons people are leaving the scene of an accident, or not stopping for hit and run victims. Now they want to present a slate of candidates to cover their tracks if elected. Their policies in Lansing have contributed to the poverty of our citizens. People cannot get licenses and they drive without them and just forget about the insurance.  We are turning our police departments into insurance collection agents when people need to get back and forth to work. 




What has George Cushingberry Jr  Done for the people?
In 2014, Saved the city $20,000 month in costs by stopping the payments to a software company charging the Detroit Fire Department for software that did not work. Code Red was Code Wrong and a payoff for the Bing/Hollier administration

If you give George Cushingberry the chance to be your Senator, common sense insurance rates and regulation with a strong Attorney General fighting for the people will be the order of the day. George will stabilize inconsistent rates statewide. Red lines belong on Ice Hockey rinks instead of neighborhoods.

Given the rejection by Oakland and Macomb Counties on regional transit, one way to solve this problem is through a state and federal massive public works infrastructure project. This comprehensive project will  replace the sewers, water and, build a regional rail system that connects to Amtrak and VIA railroad in Canada.  This will create lots of jobs and money recirculating back into the community. A good example is the sewer separation in Lansing Michigan that created better roads after the new pipes were laid down. With the current occupant of the Office of the President of the United States, this will never happen.

A vote for Adam Hollier is a quick return to the failed Educational Achievement Authority that operated as a criminal business enterprise upon the Detroit Public School System.

The victims of the crime are the Children and the integrity of public education. From the first chancellor to principals of schools, the supporters of Hollier’s candidacy are counting on people not reading to finish the job they started on looting public education.  Just look at the great work they did with our schools like Benjamin O. Davis Aviation academy and Palmer Park (aka Hampton JR High School). The financial damage inflicted upon the Detroit Public School District by these emergency managers is inexcusable and the violators should be prosecuted. Hopefully our next Attorney General Dana Nessel can work on the Detroit School Board to restore the integrity to education.

As for voting for Brian Banks, c’mon man!  The 2nd coming of Virgil Smith is running an expensive campaign that if he got elected, we would be without representation again because he would have to resign again because of looming legal problems of a life in prison for being a habitual offender if convicted again. It is clear that the insurance industry lobby is sponsoring him to divide the vote like last time.



Don't Get Confused by Watching Fox News.

This is no time to experiment with another bunch young so called progressive rookies endorsed by endless money of television commercials, mailings, bulletin boards and dazzling websites, sponsored by groups that do not have the people’s best interest at heart. Voting for Hollier, is another vote for the plan of the KKK. They support Aiyash because he does not want you to read and, Banks is sponsored by people that know he will be legal trouble again forcing him to resign or go to jail for life. We do not need a repeat of the Virgil Smith fiasco and the sexual harassment blitz sponsored by alt-right Fox News network. The City of Detroit will protect the taxpayers from frivolous lawsuits. We don't need a make work program for lawyers, we need a make work program for our infrastructure.

Highland Park and Hamtramck Opting Into State Marijuana Laws

There is an effort currently underway to allow the voting citizens of Highland Park Michigan to allow Marijuana businesses in their community.  A group of concerned citizens is circulating a petition to create an ordinance to regulate the number of businesses within the City limits.  1000 valid signatures from registered voters in Highland Park Michigan are needed to place the issue on the ballot. If enacted by a citizen vote, the ordinance will be implemented to manage the growing Marijuana industry within City limits.

Out of all of the candidates running for State Senate in District 2, George Cushingberry Jr is the only one who is running that has consistently supported citizen efforts by enacting legislation as a Michigan State Representative and a Detroit City Council member.  The Highland Park legislation will be nothing like the restrictive Detroit ordinance and, will voted on by the people instead of a mayor and city council by themselves with no public input.

In other news, the City of Hamtramck Michigan is currently reviewing their legislative policies for opting into state law. From the last public hearing held in early June, city leaders were very receptive to citizens opting into state law. The mayor and city council listened to their citizens speak about the benefits of the Marijuana business in helping to create jobs, and support the quality of life for citizens especially city employees, retirees, and schools.  As of this date, the City of Hamtramck is currently weighing all options.

A Vote for Adam Hollier is a Vote to return to the EAA

Electing Adam Hollier as a State Senator would be a reward and a pat on the back for supervising the dismantling of Detroit’s public schools, especially workers’ rights and health care. State Employees do not need any more abuse from the failed polices of financial mismanagement and fraud. With the assistance of Emergency Managers, the biggest Ponzi scheme ever was inflicted upon the people of Flint, Benton Harbor, Hamtramck and, retirees from public service.  




In Detroit and under the leadership of former Mayor Dave Bing, Adam Hollier supported the implementation of the Educational Achievement Authority, an organization that made the Detroit Public School System woefully inept.  During his tenure schools buildings were raffled off to the highest bidder and assets like computers and aircraft were sold to charter schools in Grand Rapids.  Student test scores were unchanged while chancellors, principals, and un-qualified teachers were forced upon students for financial gain.

Despite the vociferous complaints from teachers and students, Bing and Adam Hollier managed to persuade two Detroit Democrats (Harvey Santana and John Olumba) to agree to expand the EAA by adding 50 more schools.  The result of this action is what you have now, Schools like Palmer Park Academy (The old Hampton Jr. High School) with ceilings falling in because of neglect. Cass Tech High school football scoreboard missing lights, new buildings being constructed when they were not needed and other atrocities committed against the children’s education.

There is no coincidence that some of the same people and organizations endorsing Mr. Hollier’s candidacy were willing participants in the destruction of the Detroit Public Schools. Some of them are still under investigation by Federal Authorities for the damage done to young minds through financial neglect. By voting for Adam Hollier, this will be like putting Bing back in charge so that the complete destruction of Benjamin O. Davis High School for Aviation careers will be complete and, the guilty in Flint MI will be granted pardons by the Governor in the lame duck session.

There is no coincidence that some of the anti-marijuana clergy in the community is endorsing Hollier’s candidacy. Their only job was to help businesses open up in the suburbs.  Business entities outside of Detroit used these people, fake news of crime and, the 80 year old myth on marijuana to create jobs at the expense of City residents.  Combined with the poor transit system that is currently in place and, the missing revenue from payroll, rent, and taxes, cost Detroit $3 million dollars and counting, by seconds.



To fix this mess, on June 22, 2018 until Nov 6th, 2018 mark your absentee ballot for George Cushingberry Jr. State Senator District 2 TWICE!  One vote to fill the partial term and, one vote to fill the 4 year term.


When you complete your vote, you will know that on August 8th, the people in District 2 will have a voice in Lansing. George stands for jobs, justice, and equal opportunity for all who want and desire to improve the quality of life. We must finish the job of creating a new aviation education complex with firefighter training facilities by a new aviation division of the Detroit Fire Department. The concept of a statewide flat rate auto insurance will be an action plan on the day he accepts the job.  You should not have to park your car in Ohio to get a better insurance rate.

Building Bridges of Unity Between Michigan and Ontario With Cannabis

          April 2018 has truly been an appreciation celebration for everyone who has been involved in changing the horrible policy toward Cannabis.  On this month people tore down a wall and, are starting to build a bridge of peace, prosperity, green jobs, and health care reform.  Candidates running for office in August and November 2018 were put on notice that if you don’t support marijuana decriminalization, save your campaign money and withdraw your application. Congratulations to Attorney Dana Nessel for winning the Democratic nomination with the help of the Michigan Educational Association Teacher’s union and the Medial Marijuana community. Her position on Pot helped to upset Pat Miles who was hypocrite by prosecuting legal Medical Marijuana patients with Federal Law disrespecting the states rights of Michigan citizens.


From Both Sides of the Detroit River,  One Love 

This was the last illegal event Marijuana event in North America and it could not come fast enough. On July 1st , Canada will formally enact recreational marijuana laws that will allow their citizens to safely use Marijuana without penalty of law.  To mark the occasion, I went on a fact finding tour of Windsor Canada and participated in the Epic 420/421 event with the proceeds going toward ending hunger in Windsor.  This event was located in front of Windsor City Hall and Police Station in front of Caesars Casino Windsor.

In the mist of a worker strike at the Casino, union members and Canadian citizens fully supported and participated in this event. Featured speakers include Sam Mellace, a medical marijuana user and rights advocate, John Turmel, a long-time fighter for legalization and Paul Hartman, a cannabis user and the brother of late comedian Phil Hartman. Paul Hartman was deported from America for “Weed crimes against America". Hartman gave a compelling speech on how Cannabis helped him beat Colon Cancer. I was also pleased to find out that the Laborers International Union of North America covers their members Medical Marijuana costs.

Building Bridges Instead of Walls.

The people were excited to see and hear guest speakers Richard Clement and Ex-Detroit City Councilmember Pro Tem George Cushingberry Jr describe the situation  in Detroit, and the fight to end the war on weed in America. The war can only be won through voting and demanding legislation by politicians to support the will of their employers. Or Else!


Building Bridges Instead of Walls 

The theme from us was to build a bridge or two of unity instead of walls of division. No one will ever get deported again from either country for the “crime” of marijuana possession. People like Marc Emery and Paul Hartman will be able to travel freely between Detroit and Windsor because, people have made a commitment to show up and vote in all elections in 2018.   The first date of early voting starts June 22nd   for the August 7th,  2018 Michigan Primary and September 22nd, 2018 for the November 6th General Election.

If you will be 18 years of age on August 7th, or November 6th, 2018 register to vote NOW or face the consequences. Vote for candidates who support legalization and, the decriminalization of Marijuana. Check candidate prior records for flip-flopping or obstructing a marijuana business while in elected office.  Be on guard for candidates and their supporters who lie about supporting marijuana business on the one hand. While the other hand is materially participating in shutting them down via zoning hearings, court orders, and enacting local ordinances.

Otherwise the Epic 420/421 event was a huge success. Charles Clarke Square is behind Caesars Casino Windsor, right in front of Windsor City Hall and the Windsor Police Department. Participants at the fest were able to purchase cannabis products without a card after paying the admission fee. There were no arrests or police incidents reported.

Other topics will be crime reduction, education and the Council's position on the 180 day moratorium on Marijuana businesses. A number of Marijuana Businesses like Sativa Detroit on Santa Barbara and 8 Mile moved to Ann Arbor. Other businesses have moved to other cities like Inkster Michigan, that have approved their ordinances by a vote of the people. 

The question is, what should the city do with the revenue once everything gets settled in Detroit?

Given the City's willingness to open safe houses for Opioid use, why are we not licencing marijuana businesses instead of shutting them down? Is there a subtle hypocrisy in this policy with government providing drugs to citizens while demonizing other citizens using their medicine with criminal and civil punishment?

Is it a better financial investment for the City into Information Technology resources by taking online marijuana applications, instead of lawyers in Corporate Council allowing only paper applications?

Voter Suppression for Marijuana Reform Creates Voter Apathy and Mistrust in Detroit

The recent opt in and zoning initiatives on the November 7th, 2017 ballot was approved in  480 of the 490 voting precincts within the City of Detroit. Both proposals passed by 98% citywide, so it is baffling when the Council introduces a moratorium and directs the City Law Department to invalidate election results. Wayne County Circuit Court Judge Robert Colombo allowed the City of Detroit to switch from being defendants to plaintiffs on the same charges that were tossed for two plaintiffs Marcus Cummings and VK Holdings LLC at 12800 E. Eight Mile.

The same Judge who deemed their case frivolous, used the same information to invalidate the ballot initiative. The City was allowed to refile charges at 12:01pm, allowing Judge Colombo to wait until 6:30pm to flip flop on the law. This is the same procedure that the Legislators in Lansing used to throw out the no vote on the Emergency Manager, reinstating them to loot City assets and poison children in Flint Michigan without fear or retribution.

The numbers below are a breakdown of the vote by City Council district.  In Districts 4 through 7, Opting Into State Law passed by 100% of the vote with Zoning passing by 98%. In City Council District 3, Marijuana passed by 98% whereas Districts 1 and 2 had a 94% percent rate of approval.  Both proposals A and B, passed by a 98% margin in the entire city.

Legislative voter fraud is when elected officials move to negate the will of their citizens after a vote because the results are not to their liking. For the City of Detroit leadership to file a motion with Wayne County Circuit Court to invalidate the results of a vote is deplorable. This action creates voter apathy,  proves the case to some in the community, especially the African American community that their vote does not count. This action by the city creates mistrust in our government among citizens in Detroit, especially the young people under 40 years of age. 

Making decisions after normal working hours so that people are not aware of what is going on until the next morning is deplorable. This should not be the new method of operation (MO) for democracy in Michigan. To stop this we must elect an Attorney General like Dana Nessel who would step up and fight for the will of the people, instead of the interest of a few. We must put good leaders with wisdom and knowledge in the Michigan State House and Senate. We must elect Judges and Sheriffs who have the people's best interest at heart.

This decision by Judge Colombo must be appealed for the sake of democracy. The children are learning from their elected leaders that their votes can be suppressed. This is not good for education, and the future of our City.  Especially to the ancestors like Mrs. Amelia Boynton who who got punched in the mouth on the Edmund Pettus Bridge in Selma Alabama so that her and others have the opportunity to determine the direction of their community by voting.
