Civil Asset Forfeiture Revenue and Marijuana Legalization by the Detroit Police Department

    In light of the recent raids on Medical Marijuana facilities in the City of Detroit this week, we asked Detroit Police Chief James Craig how much money does the Department make from Asset Forfeiture.  The Chief responded with a chart that shows over a 3 year period, the Department made $7.3 million dollars from taking assets under the Civil Forfeiture programs. The breakdown is as follows:

The figure shows that there needs to be a redirection of assets so that Marijuana based businesses and, the policy on Civil Asset forfeiture needs some serious re-direction of funds toward expenses like retiree pensions and healthcare.  This is a large amount of money to make from taking someone’s money and property for Marijuana possession and, never charging the person for the crime in a court of law.

People on the receiving end of this lose everything seized to the agency who made the initial contact if; the person does not contest the seizure in 10 days. After 10 days, the money or asset(s) that was taken from a home or person during a police raid is kept by the arresting agency and sold for profit. The raid on the facility at Puritan and Hubbell on July 14th, 2015 is a prime example of this type of asset forfeiture abuse by law enforcement.  On Puritan there are 7 churches that are within 3000 feet of the school.  City wide, there are numerous hair shops and churches that are across the street from each other.

This un-even enforcement of the Marijuana Laws creates an incentive for police agencies to conduct raids as a profit center for the Department instead of the protection of the citizens.

The only way this will stop is if you show up to vote and elect people who want to make this type of change.   You can also direct change through a ballot initiative that will take 2000 signatures from registered voters in the City of Detroit.  Or you can force change by signing the legalization petition hosted by www.milegalize.com to fully decriminalize and stop the War on Weed.  The revenue from legal Marijuana sales will make more money than the Water and Sewage system maintained by the Great Lakes Water Authority.


We have more people in new jails with no pot holes in their walls and, at the same time we have horrible roads, declining education opportunities and, retirees that have dwindling pension benefits. Participation in the MI Legalize www.milegalize.com  effort will address these problems.  We are expecting much better out of our elected leadership because, the War on Weed in the City of Detroit and the State of Michigan is a complete failure and, a waste of law enforcement resources. 

Finally if the Detroit Branch and the Michigan State Conference of the NAACP can honor Kid Rock, then they are morally obligated to support decriminalization of Marijuana use because of the impact on the community especially citizens of color.

Marijuana Policy at Mackinaw? A 2016 Ballot Question To The People

During the Mackinaw Policy Conference, a new effort to allow Michiganders the legal right to use Marijuana without arrest, prosecution, and discrimination was introduced.  The group MI Legalize (www.milegalize.com) is spearheading an effort to place this issue on the ballot in November 2016. This Marijuana legalization effort if adopted by the people will allow municipalities to regulate this industry with 20% of the profits going to the city or township the provisioning center is located in. The current Michigan Medical Marijuana Act will remain intact.

Michigan residents will have another chance to determine the direction of the management and regulation of the exploding Marijuana Industry. Michigan voters have the opportunity to force the reform of the current system by electing responsible leaders who will do the following:
  1. Getting a Picture of the Cardholder on the Medical Marijuana Card
  2. Removing all Marijuana Convictions from citizens who are incarcerated in the legal system
  3. Use the growing revenue to revitalize blighted properties in Detroit
  4. Eliminate the requirement of placing Medical Marijuana in the Trunk of your car
  5. Remove Marijuana from the Controlled Substances Act
  6. Pot profits for Potholes, School Funding, Retiree Pensions and lowering Co-Pays on Health Insurance with the Affordable Care Act.

Since the Ronald Regan revolution of the 1980, the prison population has quadrupled to 2.4 million people. Cost per prisoner ranges from $21,000 to $33,000 per year for each person within the US Prison population. 20% of State Prisoners and 51% of Federal prisoners are in jail for Drug Charges like possession of Marijuana. Compared to 4% of the prison population is composed of robbery and 1% for murder, this is a huge financial commitment to keep people locked up. Currently, the State of Michigan spends up to $2 billion dollars a year maintaining their Department of Corrections facilities. On a Federal level, prison costs are expected to rise to 30 percent of the Department of Justice's budget by the year 2020.

The ballot proposal by the group MI Legalize will put a major dent and spur a massive redirection of funds used to prosecute people for Marijuana crimes. The breakdown of the revenue that will be generated by this effort will direct 40% of all profits for transportation, 40% to the school aid fund, and 20% to cities and townships where the business is located. By voting in 2016 citizens can elect State of Reps that will introduce legislation to repeal the law that required people to carry Marijuana in the trunk of their car like a weapon.  This one law is responsible for many arrests, and convictions of Michigan Citizens was endorsed by prosecutors and a few mis-guided Michigan State Senators who were “influenced” by Attorney General Bill Schuette and, the Michigan Sherriff’s Association.

Citizens can finally force the Department of Licensing and Regulatory Affairs (www.michigan.gov/mmp) to place a picture on the Medical Marijuana card after 6 years of operating the program, calling an end to the legislative buffoonery when it comes to Information Technology. While other states like Arizona allow you to upload a passport like picture, Michigan officials are woefully lacking and intentionally slacking off to sabotage the Michigan Medical Marijuana Act, one of Michigan’s only profit making programs in State Government.

If Marijuana is to become legal then, we want our citizens of all races, religions, spiritual beliefs, political or sexual preference, etc. to have an equal opportunity to participate in this industry.   Based on population as of 2014, Michigan has 80% more citizens at 9 million residents than Colorado has at 5 million residents. Therefore, Michigan will make more money than Colorado from the legalization of Marijuana. Schools, Roads, and Retirees will benefit because a City or County Government can fund pension programs and defray the cost of their healthcare by diverting the 20% of profits into the pension system.

This effort needs 302,400 signatures to be collected by circulators who are gathering signatures from REGISTERED voters.  If you are not registered to vote please do so ASAP.  If you are a felon or know a felon who is NOT inside of a correctional facility, please inform them that they are eligible to vote. This is the non-violent social change that Dr. Martin Luther King was advocating when he was alive and when people got beat up on a bridge to get the right to participate in their government.

Protecting the Retired after Bankruptcy with the Membership

Question:
What should Members do to protect their pensions from being exploited?

Answer:
Be sure to monitor board proceedings and monthly statements regarding money management, and health care regarding the clawback feature of your benefits. As a part of the bankruptcy settlement, all that was taken from the retirees will be restored once the balance sheet shows a profit. All Americans must have health care as required by law. Therefore with the clawback feature of the Voluntary Employee Benefits Agreement (VEBA), retirees can ask for things like lower monthly premiums on their Affordable Care Act health insurance, $5.00 flat rate co-pay or, other incentives decided upon by the membership. 

To make this work, you must also go to meetings and participate. If you are not able to attend, you may want to consider having an advocate group or someone who has the time to monitor the accounting on the behalf of the groups. This would fully protect the Police and Fire Fighters who do not pay into Social Security and, General Retirees who do pay into Social Security and got screwed also. Therefore we must think outside the box and, in some cases just totally forget a box and think like a ball.

What is clawback?

One proposal is to use the clawback feature of the VEBA to look at alternative funding for City retirees health care and cost of living changes beyond their control.  With the language of Michigan Senate Bills 427151045439, and 5440, revenue from Provisioning Centers, Safe Testing Facilities and Industrial Hemp development (click here to see a hempcrete home) can be approved to fund retiree health care costs.  States like Colorado and Washington have generated over $300+ million dollars in revenue from Marijuana sales and agricultural Industrial Hemp development.

Products like concrete for bricks and drywall will help build homes and business from Industrial Hemp or the Male Cannabis plant. An investment into new construction projects like redesigning and reopening City Airport for Commercial air traffic is a proposal that will help generate revenue in the form of new business and blight elimination.  Trade schools encouraging public service jobs for youth and people in general who want a trade, job, or career is a sound investment in the future with pension funds. Why? because you need new business and skilled people to pay into the fund and, that requires knowledge and a well-paying job.  The late Mayor Coleman Young once said that solution to progress in Detroit is a well-paying job with a living wage.  This business plan worked for Henry Ford and, now we have to work a new plan for the City of Detroit.

With the recent federal convictions of prior pension board managers, we feel that the eyes of pension participants is of the utmost importance. Councilmember Pro-Tem Cushingberry Jr. welcomes the FBI, GAO, M.L. Elrick, Sharon Epperson, and anyone else who want to inspect the books of the City of Detroit regarding investments and money management. The retirees will never ever have to put up with this again without their knowledge. In other words the City of Detroit is welcoming you to look at the books and, one day it will be online in real time. With liberty and financial justice for all.

Break Every Chain: Marc Emery's shackled ride through the Detroit/Windsor Tunnel on the way to Freedom and the Right to Vote

Marc Emery returned home to his wife and Canada a free man on Tuesday, August 12, 2014 @ 4:20pm EDT after serving 5 years in a US Federal Prison for selling seeds. Dressed in a T-Shirt, Shorts and, a brand new pair of Nike gym shoes, Marc was flown in shackles and chains from Louisiana to Minnesota and dropped off in Toledo where he was driven to the Detroit/Windsor tunnel.  At the Canadian border the chains and shackles were removed and, he was released to his wife at the Windsor Police Station to a cheering crowd of supporters.

He was met at the Windsor Police Station by his wife Jodie and a crowd of international supporters with some of the best BC Bud you could get your lips on. Marc Emery gave a 1 hour interview to the press and the people regarding his time in the USA.  He was VERY complimentary of the United States and the progress made in decriminalizing Marijuana and stated the USA is farther ahead than Canada and that Canadian youth must participate in the upcoming election in 2015.  Canadian Prime Minister Stephen Harper is about where George Bush was and, Michigan Attorney General Bill Schuette is on Freeing the Weed.

Marc’s message was very clear regarding the importance of participating in the political process by voting. He quoted Martin Luther King and is well read on the struggles of Malcolm X and the Civil Rights movement. He spent time in Mississippi with prisoners who were sympathetic to his plight and received thousands of letters supporting him from American citizens who are tired of being victims of a losing war on drugs. He was very adamant and insisted that voting is VERY important if people want true change in their communities.Currently, Marc is banned forever to return to the United States of America because of his “conviction”.  Marc made the point clear by inferring that “By voting and participating in the political process, laws will be changed so that employees of the people like President Obama, Gov. Snyder, Mayor Duggan and, other elected officials can sign laws and ordinances to remove prohibition on people like Marc Emery, Adam Brook and, Ryan Bashore so that they can travel to different countries without fear because of their political beliefs.”

Marc and Jodie emery are planning a 30 day tour through Canada to start the removal process of current Prime Minister Stephen Harper by registering and taking people to vote by 2015. In America, the current crop of Presidential Candidates for 2016 are totally weak when it comes to Marijuana decriminalization.  There is an election in Michigan on November 5, 2014 at 7am EDT with early voting starting two weeks prior to that date.  Voting Locations at Wayne County Community College East and West Campus have free parking whereas Election Central on Grand Boulevard is closer for people who are driving around downtown/midtown.

A VIP reception for Marc Emery at Detroit City Airport in August? Who is Marc Emery and the Importance of Voting

Marc Emery is a Canadian Citizen that has spent the last 5 years in a Federal Jail in Mississippi and Louisiana for selling cannabis seeds in 2005.  His country’s leadership does not want him to come back. However the citizens of his home province dearly want him back.  This man was extradited to the United States at the request of the US Drug Enforcement Agency because he had a lot of American customers that wanted his products.   Now that he is almost home, he will be leaving America via the Detroit/Windsor Tunnel Tuesday August 12th in the morning. 







He is leaving an America when we the people declared an end to the war on weed since the time that he has been incarcerated. Since 2005 31 states have either legalized or have pending legislation on removing Marijuana from the Controlled Substances Act. Therefore “weed the people” of the City of Detroit, State Of Michigan and United States of America would like to give Marc Emery a chance to say goodbye and apology from the People of the United States for; Wasting our monetary resources on the pain that bad policy on Cannabis inflicted on Marc and Jodie Emery. 

We would like the US Marshals to fly Mr. Emery into Detroit City Airport on August 12th where an Official Welcome to Detroit gathering awaits him as he steps off the plane.  This is before he is given a motorcade to Canada via the Detroit/Windsor tunnel. He will be “processed” by the Canadian Security Agency and allowed to go home to Vancouver British Columbia via friends, supporters and, a chartered flight home.

We hope that the Emery family can come back to Detroit and party with us sometime soon. If they do come back, it will be over the new international bridge from Windsor or, purchased duty free cannabis seeds at the duty free shop on the Ambassador Bridge and bringing them to the USA.  When he comes back there will be some fine Sativa waiting for him. To make this change you have to take your bud with you to the ballot box. (Early voting in Detroit until Aug for the primary and October for the general election).. Industrial Hemp grown in Michigan to manufacture products like building materials for homes will create 10,000 jobs for citizens further stimulating the economy. Jails will have to close down because of the removal of prisoners for small drug crimes and, redirecting resources to reduce violent crime and shootings through the teaching of conflict management.

Now that Marc Emery is leaving, we have to work to Free the Lansing Michigan 7 and other drug war prisoners from the same fate.  Before the end of Barack Obama’s term as President, he will remove Marijuana from the Controlled Substances Act and make sure that it never reappears again.

A Detroit City Council 90 Day Progress Report, On a Mission of Positive Transition.

Detroit City Airport hosting a regional Air Carrier and upgrade of the facility within 2 years is on the agenda of the Detroit City Council.  With Federal Aviation Administration support, City Airport will be upgraded with longer runways and a people friendly terminal. Airport property is located in the 3rd District and Councilman Scott Benson's Office will be the point office for project.  With the airport’s strategic location near Downtown Detroit and neighboring suburbs, people who live in Gross Pointe will not have to drive so far to Metropolitan Airport.  City airport will serve the people similar to Midway Airport in Downtown Chicago.

The Council and the Mayor are making plans with the Obama Administration to make this a reality before he leaves office in 2016.  The recent interest in the Tuskegee Airmen and their heroic efforts in the service to their country will honor their memory so that our children never forget their sacrifice.  This is a project that will more that prove the cohesive working relationship by the council-members. When the elected leadership of the City of Detroit gets their full opportunity to govern as voted upon, you will witness a sea change in policy. On October 1st, the Detroit Police Department will be under control of the Mayor and the Council by law.  Kevin Orr will be flying back to Washington DC and, will only come to visit when the Washington Redskins football team comes to Detroit to play the Lions.

Within 90 days of taking office, the City Council and Mayor have:
1.       Agreed to reopen closed Recreation Centers in Northwest Detroit.
2.       Appointed board members in areas like the Board of Review
3.       Turned on over 500 lights a week
4.       Improved the communication through the use of technology

8.   Lanquage was submitted by Council President Pro Tempore George Cushingberry Jr.  for a City Ordinance requiring municipal regulation of Medical Marijuana Provisioning Centers and Safe Testing Facilities. This City ordinance is a sister law to the State of Michigan House Bills 4271 and 5103 which are awaiting the Governor’s signature.

Citizens who live in the districts now have a district manager who is responsible for their needs. These positions are created by law via City Ordinance. Mayor Duggan and Council President Jones have provided the new leadership and dynamic change that residents demanded.   Jobs are coming back to the City because we are looking for a few good men and women to replace the aging workforce.

Municipal monitoring of provisioning centers and testing facilities for Medical Marijuana patients will put a quick and fast end to the smash and grab raids being performed by law enforcement resources of the City, County and State.  With an election coming up in August and November, the citizens of Detroit will be able to have a legitimate say in the future of our City.  You must show up with your ballot in 2014 or, let others continue enforce the current climate of operation. City Council is always open to listen to their constituents and, do not hesitate to contact your City Government if you need to because there is and, never will be an attempt to hide City Business from the residents.

Notice of Public Meetings & Hearings in the State of Michigan and City of Detroit

Two public meetings that will have an impact on City of Detroit residents will be held in the next few days.  Starting Tuesday, March 11, 2014 in Lansing Michigan written testimony will be taken by the Michigan Senate Government Operations Committee regarding two House Bills  that would:
 

1.     Allow holders of valid Michigan Medical Marijuana cards to purchase Medical Marijuana products from without penalty of law, as approved by the local municipality

2.      Establish fees for municipalities to license, grade and, regulate Medical Marijuana use through the establishment of Licensed Safe Test Facilities to test for quality of product.

3.      Effectively end all raids by law enforcement on Marijuana Businesses in the State of Michigan.  This would have a dramatic effect on the use of local law enforcement resources to fight a drug war on Pot that has been demonstrated to be an expense that is not worth the cause.
a.     This will assist agencies like the Detroit Police, Wayne County Sheriff and, State Police in the management and redirection of resources.

House Bill HB 4271 (click here for full reading of 4271) will allow Cities, Townships and, Villages to regulate provisioning centers and testing facilities within their jurisdiction.  With the payment of a registration fee to the local government, Medical Marijuana patients can safely purchase their medicine without fear of prosecution under penalty of law.  House Bill 5104 (click here for full reading of 5104) will allow the use of marijuana that is not smoked by eating it in brownies, canabutter grits, cookies, tea.
 

These bills will allow the City of Detroit to establish a department dedicated to operation and management of Certified Municipal Safe Testing Facilities. These facilities will grade the products that are being sold by provisioning centers for quality and other factors. These bills are one step from a vote by the entire Michigan Senate from a becoming law.  There are some Senators like Republican Rick Jones who have introduced bills to weaken and sabotage the Michigan Medical Marijuana Act of 2008.  One of the most outrageous examples is the requirement that you transport your medicine in the trunk of your car.  This law (PA 460 of 2012) has generated thousands of dollars off the backs of Michigan Medical Marijuana patients under the guise of public safety.  With the help of Democrats, these harmful bills are becoming law leading to a rebirth of a new Jim Crow in Detroit.
Your communication with the Michigan Senate is crucial in protecting citizens from being sent to a prison for profit system that is befitting stock holders instead of the citizens.  Your written testimony will be taken for the official record so let your voice be heard by contacting your State Senator and telling them to vote Yes on HB4271 & HB5104.  This is an election year for the Michigan Senate and House in 2014.

Using Belle Isle for Business, Fun and, Pleasure under State Of Michigan Rules.

If you plan to use Belle Isle this year, there are new rules in effect regarding shelter rental and using the park.  If you want to provide commercial service or use that includes the following: money changing hands, exchange of goods or services, creation of good will, growing of a business, or promotion of a good or service, you will have to fill out an Application/Permit to Use State Land (FormPR1138-1).
Providing Commercial Service falls into 4 categories:
1.       Lease
2.       Concession
3.       Commercial Operating Agreement
4.       Use Permit

Under a lease you can have up to a 25 year period of use and grants exclusive use of the parcel of land for a specific purpose. The business must fit the mission of the DNR and the public interest and the Business owner must carry liability insurance.
Example of a Lease:
1.       Marina/Harbor
2.       Boat Access Site
3.       Restaurant
4.       Boat Wash
5.       Ski Hill
 
A Concession is a business that is requested by the Department of Natural Resources through a bid specification list.  Bids can be sole sourced or put out for competition at the discretion of the department. These business can generate up to $650,000 per year with Firewood, Ice and, Vending operating concessions generating up to $300,000 per year.

Commercial Operating Agreement:
A commercial operating agreement is a document that allows for a business to perform a service on State Land. These businesses can generate at least $200,000 a year and, the fee is based on the impact to the resources like the: Land, staff and, other users.

Examples of COA’s are:

1.       Livery
2.       Marine Boat Repair
3.       Model Airplane Flying
4.       Gilding Service
5.       Whitewater Rafting
6.       Recreational Vehicle Rental

Use Permits are for one-time or re-occurring events. These events can generate between $100,000 & $120,000 per year. Fee is also determined on an Impact Basis to the land, staff and other users.

Use Permit Examples are:
1.       Pedestrian / Bike Race
2.       Triathlon Event
3.       Boat Race
4.       Firs time business ventures or unique options that are limited.

A Special Use Permit is used if you want a shelter for a family reunion for alcohol in a State Park. However, the State has decided to keep the City of Detroit’s reservation system until the end of 2014.  Open alcohol containers are only allowed in the area of your shelter rental through the acquisition of a Special Use Permit.
Violations will be prosecuted in 36th Court by the Wayne County Prosecutors office per Sgt. Arthur Green DNR Area Supervisor of the Law Enforcement Division.
