On My Last Day Of Working for You In Detroit City Council District 2 - A Summary

I knew this day would come.  Turn in your badge, keys, and parking passes. It was a real blast!   I met a lot of wonderful people and got some things done for the City. Starting with the Detroit Fire Department in 2014, they were paying for software that did not work. In 2017 they are using the latest technology and it works for a change. 

Firefighter health care will be subsidized by the Marijuana Excise Tax Fund that will pay into the First Responders Presumptive Care Fund managed by the Michigan Department of Treasury. We also helped to fix a few drain issues for constituents during the flood 2015 and, got the garbage picked up when the Advanced Disposal trucks would miss a house or two.

I truly enjoyed correcting Detroit News Editor Nolan Finley regarding the selection of Council President Jones and, Council President Pro Tem George Cushingberry in 2014. I told him that he was wrong, where he could go, and how he could go. Four years later, I proved to be right by saying that “Jones and Cush will lead a new push for a better and brighter Detroit”. 

One of my proudest moments was on August 12^th, 2014, when I went to Windsor Canada on behalf of American Cannabis supporters to give my deepest apologies to Marc Emery and his wife Jodie, for the cruel treatment that the United States of America inflicted upon him for selling Marijuana seeds. He is a Canadian Citizen who lived in Vancouver British Colombia and was arrested on behalf of the DEA in 1999.

He was held in a Federal prison in Mississippi for 5 years and unlike other international prisoners who are flown directly home, he was being humiliated by being forced out of the country through the Detroit/Windsor Tunnel 3000 miles away from his home.  He arrived in Windsor CA from Mississippi in shackles and chains with $170.00 US dollars and a brand new pair of Nikes. This cruel and un-usual punishment inspired Mr. Emery to embark on the largest voter registration drive to elect Prime Minister Justin Trudeau to office in 2015.

We were proud to stimulate the further development of Detroit City Airport as an Airport. We hope that hometown investors like Marcus Channey of Metropolitan Airways are allowed to invest millions into the property so that he can operate his airline from the location creating jobs. We also hope that the new Council does not foul up the progress being made for Benjamin O. Davis Aerospace High School to be relocated to the Airport grounds. When this happens, the school can restore their FAA/FCC certification program that was stolen by the mismanagement of the Emergency Managers.

We are glad that we helped Tindal Center reopen in Northwest Detroit.  We also feel that Johnson Center will be open one day. We wish Councilmember Roy McCalister the best to get this job done, along with the AMTRAK train station at State Fairgrounds.  This land is long overdue for development and it is time to quit screwing around with it.

As I leave this 13^th floor office for the final time, I can say that we did “Free The Weed for the jobs we need”.   All naysayers, doubters, and talk about-ers were wrong. Despite a few in the neighborhoods who come to hearings presenting falsified data and forged documents in opposition, both Marijuana ballot proposals passed by 60%. In every precinct in District 2, voters overwhelming chose to opt-into State Marijuana laws and decide where businesses will be located and, how they are operated.  The additional revenue from this industry can help Detroit City Retirees restore some of the damage inflicted upon them by State of Michigan financial mismanagement.

On Nov 7th - Vote YES on 24 and 61 for Firefighters Health Care In Michigan

Council President Pro Tem George Cushingberry Jr. recommends a YES vote on revisions to the Marijuana Facilities ordinance so that it will benefit Firefighters in Detroit and Michigan. Starting on October 1^st, 2017,  30% of all revenue from the Marijuana industry will benefit the first responder presumed coverage fund created in section 405 of the worker’s disability compensation act of 1969, 1969 PA 317, MCL 418.405.

This fund is being maintained by the Michigan Department of Treasury so that firefighters who contract cancer from hazardous burning material on duty will be compensated for their injuries.  The current ordinance harms these first responders needlessly because of a perceived prejudice from a few individuals that did not take the time to read to comprehend the information they need to make an informed decision.

Pursuant to Public Act 515 of 2014 the First Responder Presumed Coverage Fund is created. The Director of the Workers' Compensation Agency is the administrator of the Fund.

In order to submit an application the first responder must:

• Be a member of a fully paid fire department or public fire authority and be compensated on a full-time basis,
• Be in active service of the department or authority for at least 60 months,
• Be diagnosed with any respiratory tract, bladder, skin, brain, kidney, blood, thyroid, testicular, prostate, or lymphatic cancer,
• Be employed in the active service of the department or authority at the time the cancer manifests itself, and be exposed to the hazards incidental to fire suppression, rescue, or emergency medical services in the performance of his or her work-related duties,
• First apply for and do all things necessary to qualify for any pension benefits to which he or she may be entitled.

The current ordinance also discriminates against people of faith who use Marijuana as a holy sacrament and as a primary part of their religion.  Rastafarians would have to invoke their rights under the Federal Religious Land Use and Institutionalized Persons Act so that they can worship.

Finally by voting YES on both issues, we will be able to monitor the businesses and stop the Green on Green crime being performed by some business owners who open up Churches and Day Care centers to prevent the opening of a facility. 

Some pastors and neighborhood groups want to allow people like Warren MI Mayor Jim Fouts to open up a school on the north side of 8 mile road to shut down a facility in Detroit and, get paid $500 for turning them into the “authorities”.

Say no to this hypocrisy by Voting YES on 24 and 61, because now is the time to get the job done!

Show up and Vote YES  on Tuesday Nov 7^th and, If you live in District 2, write in the name of George Cushingberry Jr., the man for you in District 2.

Firefighters Fight Cancer with Weed Proceeds from Proposed New Laws

Starting September 22, 2016, firefighters in Michigan will benefit from Marijuana Revenue when 30% of all sale proceeds are earmarked for the Firefighter Presumption of Cancer and First Responder Presumed Coverage Fund. Marijuana advocates cheered this part of House Bill 4209 of 2015 because it is similar to the fight to remove all criminal penalties from the books for the plant. This is another example of how the plant can return a benefit to the community and save lives at the same time. When a firefighter with 5 years of experience files this application, it will suspend the employee’s workers' compensation claim against his or her employer.

The employer will file a counter claim against the applicant based on the following:

“ The statutory presumption may be rebutted by scientific evidence that the person was a substantial and consistent user of cigarettes or other tobacco products within the 10 years immediately preceding the date of injury, and that this use was a significant factor in the cause, aggravation, or progression of the cancer. “

The Department of Licensing and Regulatory Affairs (LARA) may not implement the Fund until funded. Thus no activity on any submitted application may take place until that date. Any application received prior to that date will be logged in by date and time when received by our office.

Firefighters and Sheriffs in Michigan Benefit from Legal Marijuana Sales with Proposed New Legislation

"Legislation will fund County Governments and Public Servants"

Michigan’s effort to legalize marijuana by legislative procedure is going to benefit counties, substance abuse agencies, and local governments.  The following package of bills passed by the Senate will create job opportunities for software vendors to bid on supplying the Marijuana Tracking System for all Cannabis business must have to continue to participate in the program. When it becomes operational, your card will be used to track the amount of marijuana each patient has purchased over time.  You will be able to possess 2.5 ounces of usable marijuana at any time in the State of Michigan.

The major beneficiary of these set of bills is the State of Michigan's 1^st Responder Presumed Coverage Fund at the tune of $500,000 from the proceeds of the Medical Marijuana Program.  The next beneficiaries are the County Governments like Wayne County who will receive 35% of all revenue from Marijuana sales. Wayne County Sheriff Benny Napolean and the 82 other county sheriffs will enjoy this cash cow on the backs of Marijuana users as soon as it becomes the law. Local governments will receive 25% of the proceeds from Marijuana for their use.

Cities like Detroit could use the money for things like rebuilding recreation centers and create green jobs in manufacturing and, education. Cities will also have the abilities to place caps on the number of businesses in their locality. Caps must be anti-discriminatory and be in compliance with Federal Zoning Laws.

The legislation places a 50 ounce limit for each Medical Marijuana Center with a valid license. Currently the City of Detroit  Building Safety and Engineering Department (BSEED) is granting conditional waivers to new marijuana business owners on the grounds that the owner works to bring the location up to code. BSEED is very generous and confident that business owners will do the right thing to be legal.

A brief analysis of the bills are as follows:

HB 4209 - license and regulate medical marijuana growers, processors, provisioning centers, secure transporters, and safety compliance facilities;  This bill creates a marijuana licensing board, an automated tracking system, an advisory panel, provisions for forfeiture, defines tax rate,  and sets civil fines. This bill grants powers to State and Local Governments to define duties regarding Marijuana in the community

HB 4210 – Gives specific definition of the content of medibles (non smoke able) Marijuana. Also spells out procedures for violations of the provisions of the card:

•       16 Ounces of Solid Medible Marijuana (brownies, cakes,  etc.)
•          7 Grams for using in a vaporizing pen
•       72 Fluid Ounces of liquid marijuana

Outdoor growing is allowed as long as the medicine is out of sight from the street, in a secure location and locked.  Security could be a dog, camera and lights so that other people don’t rip you off. Companion Senate Bill 0141 introduced by Senator Coleman Young seeks to address the inequities of this bill like vehicle transport and other issues that must be worked on by the House of Representatives for a compromise.

HB 4827 – This bill will allow software companies to bid on the Marijuana Tracking System because it defines the specifications for the developers to use in designing and implementing the Statewide system.  This bill will track the sales of marijuana between patients and the growers who interact with retail sites.

In summary, these pieces of legislation have a lot to be desired. The transport law that was enacted by former State Senator Virgil Smith has been declared unconstitutional by courts in the State because it exceeds the current Michigan Medical Marijuana Law.  The three tier system for growing will open up opportunities for growers, testers, and manufacturers.  Local law enforcement will be released to go after Meth and Heroin users who are really destroying the neighborhoods and the country with their drug of choice.

Benjamin O Davis Academy for Aerospace and Fire Training at City Airport

Today Detroit City Council President Pro Tempore George Cushingberry Jr. proposed that the city add $200,000 to the Fire department’s budget  for the purpose of completing a plan to build a new Benjamin O. Davis Academy of aeronautics, fire prevention, and, emergency medical service(EMT) on the grounds of Detroit City Airport.

This unique facility would maintain the FAA approval for the aeronautic and fire aeronautical programs. Mr. Cushingberry expects that a Request For Proposal (RFP) could be let for an estimated $10 million dollar school which will be paid for from rents from the City and Detroit School District. This effort to bring aviation careers to Detroit students is similar to the development in Grand Rapids Michigan at the Gerald R. Ford Airport in Grand Rapids Michigan. The State of Michigan has made a significant investment in the development of this project and the same thing will be done here in Detroit.

This proposal if approved will save the taxpayers dollars because the Detroit Fire Department will have a dedicated fire training facility in the City of Detroit. This investment will give us a unique opportunity to continue the legacy of aeronautics like the Tuskegee Airmen of which Mayor Coleman Young was a proud member of.   Most important, the Aeronautics program will be moved back to Coleman Young International Airport where it belonged in the first place.

A Toast to Deception by the
Emergency Manager and Flint Officials

          The situation in Flint Michigan regarding the water is a criminal act of negligence committed by employees of the Michigan Department of Environmental Quality.  We are strongly recommending that Barbara McQuade and Loretta Lynch with the United States Department of Justice to convene a grand jury to investigate and prosecute anyone involved in the falsification of documents that produced this disaster. There is no excuse for this criminal behavior from Civil Servants who took an oath to serve the people with honesty and integrity.  As compensation to Flint residents, their co-pays for the Affordable Care Act shall be significantly reduced by %95 to %100 to accommodate the health care needs of the affected.  When the water is so bad that General Motors can’t use it to build their cars, then why it was good for people to drink according to State of Michigan “experts”. The participants in this modern day Tuskegee Experiment for profit shall be stung like a Hornet in a court of law.

        The process for obtaining a License for Marijuana Caregiver Centers is taking place as we speak. Fees by law will not be higher than $1000 and through the referendum process a fair and equitable ordinance will become the law of all the people.  Unfortunately, there are some members in our community who want to create a problem that does not exist.  There are some in the community who say that these places bring crime and drive the values of property down.  Under further inspection by Council staff members of these businesses, these allegations are not true. Recently in January of 2016, Detroit Police Chief James Craig was quoted on Detroit Speaks with Cliff Russell (WCHB 1200 AM Detroit MI) that the crime numbers associated with these Marijuana places are not there and, the department has more issues to deal with like murders, car jackings, and mentally ill people that need help instead of jail.

        We have African American pastors that own Caregiver Centers that employ many people. They do not support the 1000 foot requirement from a religious institution and requesting that this and other provisions be placed on the ballot for November 2016. Furthermore some of these pastors should know better and seem to forget the history of the Slave Trade were Black People sold other Black people into slavery. In this case the pastors support keeping marijuana illegal to support the for profit prison industry.  There are cities like Ypsilanti, Lansing, Flint, that have many Caregiver Centers in their cities, therefore the allegations made by community groups regarding these places of business are unfounded and remind you of the 1939 Reefer Madness movement.

                The Livernois Avenue of Fashion is thriving again with new lights and businesses that meet the needs of their customers.  The lights took longer than expected because the wiring on the street was over 50 years old. We support the business owners on the Avenue who want the parking meters removed from the street.  They have caused the business owners to lose customers because of the inflexibility of the meters and our office is working with the owners to resolve the problems. We want more people to start voicing their concerns to Wayne County and Lansing for the condition of Outer Drive from Livernois all the way to Southfield Freeway.  Between Livernois and Wyoming, the road conditions are atrocious and needs to be paved over immediately. We want to highlight and give a shout out to the new Hartford Village complex on Meyers and welcome to our new residents who will be living there.

                The empty land at the State Fairgrounds has a site plan and layout by the Magic Plus LLC group. We hope that this group can expand their efforts as far as they can between Woodward, John R, 8 Mile, and McNichols because this area is begging for redevelopment. The plan is for a movie theater,  housing, and a fully modal transportation center that includes, Amtrak, Light Rail, DDOT, and SMART. On 7 mile and Woodward a faith based transportation hub in partnership with the Tasty World, BP Gas Station, Miles Green Acres Compassion Center, and the Perfecting Church will facilitate the connection between North, South, East, and West distances in the city.  We support the participation of the Magic Plus Group in the re-vitalization of Detroit.  We will continue to support the development of a regional light rail system that will rival Miami, Washington DC, and New York rail systems. 

        This growth within the district may result in the re-activation of the fire house at Curtis and Livernois that is 2.5 miles from Pasteur School into a fully operational fire house. In layperson terms there will be two fire trucks instead of one with a rescue unit. Some of the older firehouses may qualify for a historic grant because of the age of the facility.  This means that a Detroit based company like CAASTI Construction Company (www.caasti.com) can redo the interior of fire houses and create job opportunities for carpenters, bricklayers, electricians, etc.  

         This growth will continue with the additional officers needed at the 12th Precinct because of the redevelopment of the old State Fairgrounds property by Magic PLUS. When this project is completed DPD will be adding at least 10 new officers to patrol the new neighborhood.

        

         The Adams/Butzel Recreation Center has a world class NHL sized hockey skating rink. It is one of the Department’s premiere recreation centers in the district. Did you know that African Americans invented the game of Hockey? (click here to find out)  If you want to learn how to play the game, then this is the place to come.  Trainers with professional hockey experience are available to teach you the basics.

         We will work to remove one of the Emergency Managers orders regarding the parking tickets. We want citizens to get a 24 hour grace period to pay a $20 fine instead of being socked $45 a pop.  Michigan cities like Lansing are forgiving when it comes to parking tickets and people.

Sign a Petition to Legalize Marijuana in Michigan

Legal retail sales from the plant will fix the roads, fund the Schools, and finance public pensions at a local level.  People who are currently incarcerated for small amounts of Marijuana will be thrown out of jail, kicked off probation, and have their criminal records expunged if this becomes the law.

This effort is sponsored by the MI Legalize, Activists and Democrats.  This law if passed will keep the current Marijuana Law intact and, allow for the sale of cannabis in the State of Michigan.  This is the only Marijuana petition that will truly benefit the people in regards to funding, revenue and fair treatment.  This petition DOES NOT allow use of Marijuana by under-age youth.  People who are promoting the Marijuana Responsibility Council request are telling this lie to get you to sign their petition.

Whereas the petition by the MRC is sponsored by a GOP based group in Oakland County with ties to New Jersey Gov. Chris Chrstie. Their petition attacks felons and removes growing rights of patients and caregivers. Their petition will fill the jails of Michigan with people and property being seized by law enforcement officials. On giving second chances to felons, if it is good for Martha Stewart, if it is good for elected leaders in Michigan, then any felon in Michigan deserves a second chance. 

It is time to curtail the felony hater aide laws in Lansing and get some common sense. The cement used for the jails belong in the roads filling potholes and fixing bridges in Wayne County instead of sitting at an uncompleted jail.   So stop by and make it your mission, to sign the petition.

We are strongly encouraging all lovers of the Automobile to converge on Woodward Avenue from August 12th, 2015 until August 16^th, 2015 on Cruise Week along Woodward in Detroit and Highland Park.  Highland Park will be paying homage to the Automobile at the Old Ford Plant Site on Woodward Avenue. This site was the home of the plant that build Ford’s first car, the Model-T coupe. In Detroit the main event will be the Crusin the “D” event around Palmer Park.

In the Main event, cruisers and City Vehicles such as Fire Trucks, Police Cars, form a big D loop around the Park on Woodward between 8 Mile and McNichols.   Last year Chief Craig headlined the Parade and the Detroit Fire Department, especially Engine 44 represented very well. This year will be even better because locations along Woodward between 8 and 6 Mile are available with permission of the property owners in advance.  Vendors and tables located at the intersection of Woodward and Goldengate will be there to greet cruisers on the road.  While you watch the Crusin the "D" you can eat some of the best Vegan food at the Golden Gate Cafe. Under the leadership of Gregory Reed, the Crusin the D event is a highlight of the District.  Currently we are waiting on approval from MDOT/State of Michigan to use the vacant State Fair Parking Lot for Cruise purposes. Talented people who love to build cars from scratch are strongly encouraged to participate in this event that pays homage to the City and Region that built a nation.

If you are going to have a real regional transportation, going East and West is a priority. The eventual crossroad for the M1 and M102 Rail System is ground zero for the redevelopment of the neighborhood, including the Old State Fairgrounds. Eventual plans for the property are a new neighborhood, retail shopping, theater complex, and transportation center.  The transportation center will include a new stop for AMTRAK trains heading to Chicago. This station will replace the station on Woodward making AMTRAK people friendly and easy to park.                 The Detroit City Council has approved a two year budget for the Detroit Fire Department that includes adding additional Emergency Medical Technician personnel and use of Global Positioning Software and Google Earth. DFD/EMS units will also have the ability to closely monitor runs to spot abusers or frequent flyers who use the EMS services for non-emergencies.  Calls are already being ranked by priority codes when someone calls in.  When the EMS unit arrives, the run is given a code and, a priority ranking system will determine if this caller’s address is in fact a frequent flyer.  Repeat offenders can be identified fairly quickly so that other agencies can provide the long term help these people need.

To cut down response time, the department has hired 66 new Emergency Medical Technicians (EMT) in 2014 with another 34 graduating on January 23^rd, 11:30am at the Detroit Public Safety Building.   DFD/EMS has acquired 15 new ambulances and have up to 12 Private Ambulance Providers that provide additional service during peak times of 1:00pm to 1:00am on call. An additional communications channel has been added to allow dispatch to communicate much better than before.

This two year budget allows for new ROMEO non-transport Rapid Response Units that are staffed by EMT’s. These units provide onsite medical service to someone until a transport unit arrives.  The color of these units are RED and they look like a small pickup truck. These units are so versatile that some of them are based at Detroit Police Precincts.  The last item of importance is the cross training of Firefighters as Medical First Responders that can give First Aid until an EMS transport unit arrives to take the person to a hospital.

With the new changes and funding the Detroit Fire Department EMS Units will be able to reduce response times and provide better services to the citizens of the City of Detroit.
